1) Parties and Definitions
1.1. These Terms of Service (“Terms”) govern your use of the Jetscrape.com website and related API/application/services (the “Service”), operated by DEMRE TARIM TURİZM TEKSTİL GIDA İNŞAAT KUYUMCULUK BİLİŞİM EMLAK İTHALAT İHRACAT SAN. VE TİC. LTD. ŞTİ (the “Company”).
1.2. “User” means any natural person accessing the Service or an authorized person acting on behalf of a legal entity.
1.3. “Customer” means the party subscribing to a paid/free plan.
1.4. “Consumer” means a natural person acting for non-commercial or non-professional purposes under Law No. 6502.
2) Scope
These Terms cover the Service, user accounts, subscription/pricing, acceptable use, intellectual property, limitation of liability, and termination.
These Terms apply to both B2B (business) and B2C (consumer) use. Where the Customer is a Consumer, the Pre-Information Form and the Distance Sales Agreement presented in the purchase flow will apply with priority.
3) Account and Security
3.1. You agree that information provided during registration is accurate and up to date.
3.2. You are responsible for keeping API keys and access credentials confidential and must notify the Company promptly of any suspected unauthorized use.
4) Acceptable Use
4.1. You will use the Service in compliance with applicable laws and third-party rights.
4.2. Prohibited uses include (non-exhaustive):

Unauthorized access to third-party systems, bypassing security measures, distributing malware

Reverse engineering or attempting to access source code

Overloading or disrupting the Service

Unlawful collection/processing/transfer of personal data, including special categories of personal data

Data extraction that violates third-party terms or technical restrictions such as robots.txt (you are responsible for your own legal assessment)

Illegal content, spam, phishing, fraud
4.3. You acknowledge the Service is a tool, and you are solely responsible for your activities and any data you obtain/provide.
5) Pricing, Subscription, and Invoicing
5.1. Fees, plans, and billing cycles are published in the Service: [● pricing link]
5.2. Payments may be processed via third-party payment providers.
5.3. Taxes and legal obligations (VAT, withholding, etc.) may apply depending on your status.
5.4. For B2C (Consumer) purchases, the Pre-Information Form is provided before placing an order, and the Distance Sales Agreement is presented for acceptance at the order confirmation stage.
5.5. Renewal, cancellation/termination, access period, and (if applicable) refund rules are described in the purchase flow and/or account/plan management screens.
6) Service Changes and Downtime
We may modify the Service to improve it. Planned maintenance, incidents, or legal requirements may cause downtime.
7) Intellectual Property
The Service, software, and content belong to the Company or its licensors. You receive a non-exclusive, non-transferable right to use the Service under these Terms.
8) Privacy and Personal Data
Personal data processing is governed by the KVKK Information Notice, Privacy Policy, and Cookie Policy.
Where business customers (B2B) use the Service as part of their own data processing activities, the parties’ obligations regarding Customer Data are additionally governed by the DPA.
9) Limitation of Liability
9.1. The Service is provided “as is”. We do not guarantee uninterrupted or error-free operation.
9.2. To the extent permitted by law, we are not liable for indirect damages such as loss of profit, data loss, or reputational harm.
9.3. Our total liability is limited to the total fees paid for the Service in the [● 12] months preceding the event giving rise to the claim (if applicable).
10) Suspension and Termination
10.1. If you breach these Terms, we may suspend or terminate your account.

11) Changes
We may update these Terms. The current version becomes effective on the date it is published.
12) Governing Law and Jurisdiction
These Terms are governed by the laws of Türkiye.
For Consumer disputes, Consumer Arbitration Committees/Courts may have jurisdiction as applicable.
For non-Consumer (B2B) disputes, the courts and enforcement offices of Antalya shall have jurisdiction.
